Terms and Conditions of Holiday Rentals
Please read the terms and conditions of the rental contract before signing the booking form contract for holiday rental, you are entering into a binding agreement. By signing the booking form you have legally accepted the Terms and Conditions of the rental form below. Once we have issued the holiday confirmation advice a legally binding contract shall exist between the Owner and the Holiday Maker subject to the following booking conditions.
Owner: Sue Manning PO Box 845 Gibraltar
Customer: The person reserving the Property for the Period.
Property: The property specified in the Booking Form
Period: The period specified in the Booking Form during which customer will occupy the Property for Holiday Use.
Booking Form: The Electronic form produced by the Owner and signed by both Owner and Customer recording the particulars of the Owner, the Customer, the Property and the Period. If the Customer comprises more than one person the responsibilities of all such persons shall be joint and several. The person signing the booking form as the Customer warrants he has the full authority and power to do so on behalf of all such persons.
Booking Contract: The contract becomes binding on receipt by the Owner of 50% of the total contract fee as deposit, which shall be non refundable.
Payment : If a booking is made, the deposit of 50% must be sent when the Booking Form is returned. The balance of 50% must be paid in full at least 6 weeks prior to the commencement of the Period. Non payment of this balance by this date may result in the deposit being forfeited and the property re-let. Notwithstanding the above in the event of cancellation six weeks or more prior to the Period if the Owner successfully lets the property for the period the Owner may return at her own discretion 50% of the deposit.
During the Period: The Customer shall not allow the property to be occupied by more persons than that specified in the booking Form without the express written permission of the owner. The Customer will use the property for no other purposes other than Holiday Purposes.
Customer Obligations.
1 To pay all telephone charges incurred by the Customer during the Period. Note: The telephone will not be connected unless requested in which case an additional deposit against bills of Euros 300 per week will be required. When the bill is received (up to two months) the deposit less charges will be returned. Excess charges will be charged.
2 To pay for any losses or damage to the Property, for whatever cause.
3 To keep the Property and all furniture, fixtures fittings and effects in the same condition and state of cleanliness as when it was found. The owner will have the right to make an additional charge for cleaning if an exceptionally dirty condition requires it.
Departure: The Property will be vacated by 12.pm on the last day of the Occupation unless agreed otherwise by the owner.
Discrepancies: The Owner has taken all reasonable steps to ensure the accuracy of the website but no liability for errors or omissions is accepted.
Insurance: The owners do not accept any liability for any loss or injury incurred during the occupancy of the Property. It is strongly advised that Customers take out their own Holiday Insurance.
